The recent upheaval within Disney’s management and the MAGA movement’s encroachment on First Amendment freedoms starkly illustrate the persistent fight for access to reproductive healthcare.This issue has become a focal point in efforts to restrict personal liberties.
The Opposition to Telehealth for Medication Abortions
A notable facet of this conflict is the initiative aimed at enforcing federal limitations on telemedicine-assisted medication abortions.
Main Highlights:
- The medication abortion procedure utilizes two medications—mifepristone and misoprostol—administered over one to three days, approved for use within the first 70 days of gestation, with an average cost around $500.
- Mifepristone works by inhibiting progesterone, a hormone crucial for sustaining early pregnancy. Misoprostol triggers contractions that help expel pregnancy tissue, typically occurring within 12 to 24 hours.
- Since the Dobbs ruling reversed Roe v. Wade, there has been a notable rise in abortions across America; approximately 1.1 million were conducted in 2023 alone—an increase from about 80,000 monthly in previous years to roughly 88,000 per month now.
- The success rate of these procedures is remarkably high at 99.6%, with serious complications arising only in .4% of cases and mortality rates being virtually nonexistent.
An organized campaign by anti-abortion activists is currently underway aimed at hindering access to these legally available abortion pills.

Pledges made during President Trump’s campaign regarding reinstating elements of the outdated Comstock Act have yet to translate into effective legislation against telehealth practices supporting access to medication abortions. Furthermore, numerous studies funded by anti-abortion organizations attempting to challenge FDA approvals related to safety and self-management protocols have been discredited due their lack of scientific rigor and transparency.
Court battles continue:, both challenging additional FDA regulations without clear medical justification or risk mitigation measures are accumulating across various state courts; Louisiana recently initiated steps towards reclassifying misoprostol as a controlled substance which could lead providers into further legal disputes over its request.
The Role of First Amendment Today
Cornell University legal scholars assert that freedom of expression encompasses both verbal interaction (words) and symbolic actions (deeds). The original text adopted into our Bill of Rights back in 1791 stated:“Congress shall make no law respecting an establishment of religion or prohibiting its free exercise; nor abridging freedom of speech or press; nor shall people be prevented from peaceably assembling or petitioning their government.”
